The exact scope of each project will depend on the package, quotation, proposal or communication agreed upon with the client.

# 2. Project Confirmation
A project is considered confirmed once the required advance payment has been received and the client has provided the necessary information, content and instructions required to begin the project.
Payment of the advance amount indicates acceptance of the applicable project scope and these Terms & Conditions.

# 3. Pricing & Payments
Unless otherwise agreed in writing:
* Customized projects require an advance payment before work begins.
* For projects divided into multiple payment stages, work may proceed to the next stage only after the applicable payment has been received.
* Pricing is based on the scope of work agreed upon at the time of quotation.
* Any additional requirements outside the agreed scope may involve additional charges.
* Domain, hosting, premium fonts, stock images, paid plugins, third-party software and other external services may be charged separately where applicable.
Lychee-E reserves the right to pause work or withhold final delivery if outstanding payments are not received.

# 4. Customized Design Services
Our customized design services are created specifically according to the client’s requirements.
Because customized projects involve dedicated design and development time, the applicable advance payment may be non-refundable once work has commenced, unless otherwise agreed in writing.

# 5. Design Revisions
The number of revisions included in a project will depend on the package or quotation selected.
A revision means a modification to the existing agreed design or concept.
A completely new concept, major change in direction or requirement outside the agreed scope may be considered additional work and may incur additional charges.
Clients are requested to provide clear and consolidated feedback to help keep the project on schedule.

# 6. Client Content & Information
The client is responsible for providing accurate and complete information required for the project, including where applicable:
* Business information
* Text and website content
* Images and videos
* Product or service information
* Contact details
* Existing logos or brand assets
* Other materials required for the project
Any delay in providing the required information or feedback may affect the project timeline.
Lychee-E is not responsible for errors resulting from incorrect, incomplete or outdated information supplied by the client.

# 7. Project Timelines
Estimated timelines depend on the scope of the project and the timely cooperation of the client.
Timelines may be affected by:
* Delayed content or information
* Delayed feedback or approvals
* Additional revisions
* Changes in requirements
* Third-party service delays
* Technical issues beyond our reasonable control
Lychee-E will make reasonable efforts to complete projects within the agreed timeline.

# 8. Client Approval
The client is responsible for carefully reviewing all designs, content and other deliverables before providing final approval.
Once a design, website or other deliverable has been approved, subsequent changes may be treated as additional work and may incur additional charges.
The client is responsible for verifying the accuracy of all business information, prices, contact details and other content before final approval.

# 9. Website Development & Third-Party Services
Some website features may require third-party services, platforms, plugins, APIs, hosting providers, payment gateways or other external technologies.
Lychee-E does not control third-party services and therefore cannot guarantee their continuous availability, pricing, policies or functionality.
Where third-party subscriptions, licenses or services are required, the applicable cost may be payable by the client.

# 10. Domain & Hosting
Domain and hosting services may be provided separately or included depending on the selected package.
The client is responsible for providing accurate registration information and maintaining active domain and hosting subscriptions where applicable.
Domain and hosting renewals are the responsibility of the client unless ongoing renewal services have been specifically agreed upon.
Lychee-E is not responsible for service interruptions resulting from expired domains, hosting accounts or third-party services.

# 11. Website Content & Legal Compliance
The client is responsible for ensuring that all information, images, documents, claims and other content supplied for use on their website are accurate and legally permissible.
The client is responsible for obtaining any necessary permissions, licenses or approvals for content provided to Lychee-E.
Where legal documents such as Privacy Policies, Terms & Conditions, Refund Policies or Disclaimers are required, clients should obtain appropriate legal advice.
Lychee-E does not provide legal advice unless specifically agreed as a separate service.

# 12. Intellectual Property
Upon receipt of all outstanding payments, ownership of the final approved custom deliverables created specifically for the client will be transferred according to the agreed project scope.
This does not automatically transfer ownership of third-party materials such as:
* Fonts
* Stock images
* Licensed graphics
* Plugins
* Software
* Templates
* APIs
* Third-party tools
Such materials remain subject to their respective licenses and terms of use.
Lychee-E retains ownership of its internal processes, reusable tools, development frameworks and other proprietary resources used in creating projects.

# 13. Portfolio & Promotional Use
Unless otherwise agreed in writing, Lychee-E may showcase completed projects in its portfolio, website, social media, presentations and other promotional materials for demonstrating its work.
If a project is confidential or the client does not wish the completed work to be publicly displayed, this must be communicated to Lychee-E in writing.

# 14. Cancellation & Refunds
If a client cancels a project after work has commenced, payments already made may not be refundable as they may cover design, development, research, planning and other work already completed.
If cancellation is requested before work begins, any applicable refund will be determined based on the circumstances and the agreed project terms.
Any refund commitment must be confirmed in writing by Lychee-E.

# 15. Final Delivery
Final files, website credentials, source files or other agreed deliverables may be released after:
* Completion of the agreed scope;
* Final approval; and
* Receipt of all outstanding payments.
Files or services not included in the original scope may be provided at an additional cost.

# 16. Website Maintenance & Support
Unless specifically included in the selected package, website maintenance, content updates, technical support, security monitoring, hosting management and ongoing development are separate services.
Any post-launch support included in a package will be limited to the duration and scope specified in that package.

# 17. Website Performance
Lychee-E will make reasonable efforts to create websites that are functional, responsive and optimized according to the agreed project requirements.
However, website performance may be affected by factors outside our control, including hosting providers, third-party plugins, external services, internet connectivity, browser updates and future technology changes.
No specific performance result can be guaranteed unless explicitly agreed in writing.

# 18. Prohibited or Unlawful Content
Lychee-E reserves the right to refuse or discontinue work involving content or activities that are unlawful, fraudulent, misleading, abusive or that infringe upon the rights of others.
Clients must not use our services to create or promote content that violates applicable laws or third-party rights.

# 19. Limitation of Liability
Lychee-E will make reasonable efforts to provide professional services according to the agreed scope.
However, to the maximum extent permitted by applicable law, Lychee-E shall not be responsible for indirect, incidental or consequential losses arising from the use of our services, website, third-party platforms or external services.
This may include loss of profits, business interruption, loss of data, loss of customers or other indirect losses.

# 20. Force Majeure
Lychee-E shall not be responsible for delays or inability to perform services caused by circumstances beyond our reasonable control, including technical failures, internet outages, natural disasters, government actions, third-party service interruptions, cyber incidents or other unforeseen events.
